National Defense Authorization Act (NDAA)

The John S. McCain National Defense Authorization Act for Fiscal Year 2019, or NDAA, was signed into law on August 13, 2018. Section 889 of this law included provisions that blocked the Federal Government from procuring or purchasing non NDAA Security Cameras and other telecommunications equipment from specific Chinese manufacturers and vendors. These Manufacturers include:

• Dahua Technology Company
• Huawei Technologies Company
• ZTE Corporation
• Hangzhou Hikvision Digital Technology Company
• Hytera Communications Corporation

These companies also manufacture and sell OEM versions of their products in the US. There are many misconceptions about the provisions in the NDAA and how they apply to the OEM distributors in the US. Arcdyn cameras, for instance, are technically speaking exempt from NDAA related regulations as they are made with a different chipset than those that are sold under the Hikvision brand. The specific chipsets that are banned are made by Huawei, but Arcdyn cameras are built with Ambarella chips, which is a US based company. While the technicality may be clear to some, there is a substantial gray area that the law fails to provide any clear guidance on.
